General

1. scope of application

These General Terms and Conditions (hereinafter referred to as GTC) apply to the provision of rooms and all other associated services and deliveries by wolke4 AG (hereinafter referred to as Guesthouse wolke4) to customers. All offers made by Guesthouse wolke4 are based on the following GTC. They form an integral part of every contract. Should these GTC contradict any contractual conditions of a customer, these GTC shall take precedence.

2. conclusion of contract

Following the reservation by the customer, the customer shall receive written confirmation of the reservation from Guesthouse wolke4. The contract between the parties only comes into effect with this written reservation confirmation from Guesthouse wolke4 to the customer.

3. services, payments and prices

Guesthouse wolke4 undertakes to provide the services ordered by the customer and confirmed in writing by Guesthouse wolke4.

All prices are quoted in Swiss francs (CHF) and include statutory value added tax (VAT).

The visitor's tax of CHF 2.00 per guest and night is not included in the price and will be shown separately on the invoice.

Guesthouse wolke4 shall be entitled to demand the entire costs as a down payment. If the customer does not fulfill his obligation to make a down payment on time, Guesthouse wolke4 shall be entitled to withdraw from the contract after setting a reasonable grace period. The customer shall be liable to Guesthouse wolke4 for any resulting damages.

If no deposit is requested by Guesthouse wolke4, the entire invoice amount must be paid by the customer by Visa, V Pay, Mastercard, Maestro, American Express, Apple Pay, Twint or in cash at the latest at the time of arrival. If payment by invoice is agreed, the entire invoice amount is due 5 days after the invoice date. In the event of late payment, Guesthouse wolke4 shall be entitled to charge interest on arrears at a rate of 5% and an expense allowance / reminder of at least CHF 50.00 per reminder.

Guesthouse wolke4 expressly reserves the right to change prices.

4. liability

The customer shall be liable to Guesthouse wolke4 for all damage and loss or other damage caused by himself, his employees, his agents or event participants or other third parties. Guesthouse wolke4 accepts no liability for theft of or damage to items brought in by the customer from event participants or third parties. The insurance of exhibition objects and other items brought in by the customer, event participants or third parties is the responsibility of the customer. Guesthouse wolke4 may request proof of adequate insurance from the customer at any time.

The customer is obliged to maintain peace and order. He undertakes to indemnify Guesthouse wolke4 in full against all civil and public law claims made against Guesthouse Wolke4 by authorities or third parties (including event participants, guests or employees and contractual partners of the customer) and to pay for all such claims.

Guesthouse wolke4 shall only be liable for intentional or grossly negligent contractual or non-contractual damage and only for direct damage. Any further liability, in particular for slight or medium negligence or for indirect damage, such as in particular loss of profit or sending or receiving the wrong access code, is excluded.

5. smoking

The Guesthouse Wolke 4 is located in a historic building. Smoking is strictly prohibited in all rooms and at the window. In the event of non-compliance, we will charge a flat rate of CHF 350.00 to your credit card or invoice you for the removal of odor emissions. Any odor emissions, etc. that require closed rooms will be charged in full to the guest according to the daily rate and room rate.

6. withdrawal of the Guesthouse wolke4

If the service to be provided by Guesthouse wolke4 under the contract is made significantly more difficult or impossible in whole or in part due to force majeure or other circumstances for which Guesthouse wolke4 is not responsible, Guesthouse wolke4 may withdraw from the contract in whole or in part without compensation to the extent of the part of the contract not yet fulfilled.
Guesthouse wolke4 shall also be entitled to withdraw without compensation if there is reasonable cause to believe that the events may jeopardize the smooth running of the business, the safety or the reputation of Guesthouse wolke4 in the public eye or if the customer breaches clause 12 of these GTC. Guesthouse wolke4 expressly reserves the right to assert any claims for damages against the customer.

7. arrival and departure times

The guesthouse rooms are ready for occupancy from 3 p.m. on the day of arrival and must be vacated before 10:30 a.m. on the day of departure.

Subletting: The hotel room is reserved solely for the registered guest and, if applicable, their companion. Leaving the room to a third party requires the written consent of the hotel.

8. block bookings / room allotments

Guesthouse wolke4 shall receive a list of participants with the following details from the customer no later than 14 days before arrival: First and last names of all guests, arrival time, payment conditions of the guests.
After expiry of the deadline set by Guesthouse wolke4, the rooms still available in the respective contingent will be released for open sale again.

9 Cancellation conditions

The following cancellation conditions apply to the cancellation of bookings as well as to no-shows and early departures.

Cancellations of individual guesthouse room bookings must be received by Guesthouse wolke4 no later than 72 hours before the date of arrival (by 2 p.m. local time). Cancellations within 72 hours before the date of arrival and no-shows will be charged the room price as booked. In all cases, an administration fee of at least CHF 10 will be charged if the reservation is canceled before 72 hours. The Guesthouse reserves the right to stipulate individual contractual cancellation conditions.

10. internet

The hotel provides the guest with free access to the Internet (WLAN). The guest is responsible for the use of the login data. The guest is liable for misuse and illegal behavior when using the Internet.

11. animals

Animals may only be brought into the guesthouse with the prior consent of the hotel and for a special fee of CHF 50 per day. Guests who bring an animal into the hotel are obliged to keep and supervise this animal properly during their stay or to have it kept or supervised by a suitable third party at their own expense. The guest shall bear the costs of repairing any damage caused by the animal.

Applicable law/jurisdiction

The contract shall be governed exclusively by Swiss law. The place of jurisdiction shall be the Regional Court of Bernese Jura-Seeland with its registered office in Biel. Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions. In such a case, the invalid provision shall be replaced by a similar but valid provision.
